Privacy Policy
This Privacy Policy (the 'Policy') forms part of the User Agreement which governs the use of the Services. Your access and use of this Site and any information you provide on the Site remains subject to the terms of the Policy.
We recognise that you value your privacy. The Policy provides information about the use and disclosure of Personal Information (information pertaining to you and/or your organisation, including but not limited to (including, but not limited to, your name, surname, email address, business name, physical street address, mailing address and postcode, business phone and business fax, mobile phone, business category and business type) and Personally Identifiable Information (information from which you and/or your organisation may be identified) collected about you on the Site. We are committed to ensuring that your privacy is protected.
It is not permitted to for Buyers or Sellers to use hidden identities or pseudonyms when transacting on the Site. Competing Buyers will be able to see each others bids but not see each others identity. Buyers of the same Registered User will be visible to each other (for example, a Registered User may have two or more Authorised Users who buy Media Lots; if one Authorised User within the user group places a bid in an auction, then the remaining Authorised Users from the same group will be able to see the identity of the Authorised User placing the bid). You must reveal your real identity to any Registered User with whom you enter into negotiations in respect of any Media Lots, prior to concluding any transaction with the other Registered User. A Registered User will require that you disclose your real identity to him or her as a pre-condition to negotiating or transacting with you.
Managing Users appointed by Registered Users shall manage their Registered Accounts. Managing Users get full access to PII (personally identifiable information) for each and every Authorised User for their Registered User.
1. Scope of the Policy
You acknowledge that any User Submission uploaded, posted, transmitted, broadcast or otherwise disseminated on the Site by you is published material and ceases to be private; such material does not fall within the scope of the Policy.
The Policy only applies to the Site, not to any external websites or other organisations, companies, individuals to which we provide links. Any information exchanged between you and any other Registered User during negotiations, dealings and transactions you have engaged in on the Site will not be covered by the Policy. Your dealings with other Registered Users may be subject to those Registered Users' privacy policies.
2. Information Collection and Processing
In order to register an account with us, you need to provide us with certain Personal Information. We will also collect and/or may require you to furnish us with transactional information based on your activities commenced and/or concluded on the Site, community discussions (for example, discussions in Buyer or Seller User Groups), correspondence between Registered Users and correspondence between us and Registered Users. We may also collect information on the type of browser you are using, your IP address and the URL you came from and go to upon leaving the Site.
Once you are registered, you can participate in various activities on the Site, including, but not limited to posting messages in our forums, creating blogs, posting or uploading material on your profile and on the Site, participating in surveys, subscribing to newsletters or other mailing lists and of course participating or transacting with other Registered Users on the trading platform via the BuyNow, Offer or Auction mechanisms.
We may compile Reports on Completed Transactions, and may make such Reports available to Registered Users.
When you register with us, you have the option of opting in to receive various email subscription newsletters. We may also wish to provide you with information about special features of the Site or any other service or products we think may be of interest to you. If you would rather not receive this information, please log into your user account and click on the 'unsubscribe' tick-box.
3. Our use of Cookies and other information gathering technologies
When you visit the Site, we may send you one or more cookies. Cookies are small text files that we transfer to your computer's hard drive through your web browser to enable our systems to recognise your browser and to provide features such as automated login on your next visit.
You can set your browser so that it will not accept cookies, but some components of the Site may not function properly or efficiently if you cannot accept cookies and you may not be able to participate in certain activities on the Site, such as bidding in an Auction.
When you visit the Site, our servers automatically record certain information that your web browser sends whenever it visits any sites. The information recorded will include your IP address, browser type, web request, URLs, domain names and other technical data.
We may also employ the use of other technologies to track the online usage pattern of Registered Users on the Site but such tracking will not be personally identifiable.
4. How we use your information
If you register with us and submit any Personal Information and/or any Personally Identifiable Information to us, we will use such information to operate, maintain and provide you with the services and interactive functionality of the Site.
We will use your email information to send you notices in respect of any bids you have made on the Site. We will also notify you by email of the progress of any BuyNow items or Offers.
You acknowledge and agree that any material which you post, upload, transmit or otherwise make available on the Site will be publicly available and may be collected and collated by us and any third parties.
We may aggregate the information (including transactional information) and statistics for the purposes of monitoring usage of the Site to help us develop the Site and the services we offer. This includes information Registered Users need us to report on where they are either the Buyer or Seller for any particular transaction.
We may provide the aggregate information to third parties from time to time, but we will not disclose to any third party any information in respect of individual deal terms or the specifics of any deals that take place on the Site.
We may use your Personal Information for non-marketing, administrative purposes.
5. Protection of your information
The internet is not a secure medium. We have, however, put in place various security procedures to help to protect your Personal Information.
Protection technologies we use include industry recognised firewalls, browser certification, password protection and limited access to Personal Information.
We keep your Personal Information confidential. Our internal procedures cover the storage, access and disclosure of your Personal Information.
We do not represent, warrant or guarantee the security of any information you transmit to us, and any transmission is carried out at your sole risk. Once we receive information we have our own security systems in place, but we do not represent or warrant or guarantee that such systems cannot be breached.
If our security systems have been breached, then we will take appropriate steps to remedy this and to notify you of any breach as soon as reasonably practicable.
6. Updating your details
It is the duty of the Managing User to set up, maintain and update any information provided to MediaEquals Limited in accordance with the terms of the User Agreement. If any of the details provided to MediaEquals Limited change, then it is the responsibility of the Managing User to inform us of any such change. In the event of any failure of notifying MediaEquals Limited of a change in details, then the Registered User shall be liable to MediaEquals Limited.
7. Disclosure of information
We may provide Personally Identifiable Information and non-personally-identifiable information to our subsidiaries, affiliated companies, or other businesses or persons for the purpose of processing such information on our behalf. We will require that these parties agree to process such information in compliance with our privacy policy and the data protection laws in place in the UK from time to time, and we use reasonable efforts to limit their use of such information.
We may share information that is not personally identifiable (such as anonymous Registered User usage data) with interested third-parties to assist them in understanding the usage patterns for certain content, services, advertisements, promotions, and/or functionality on the Site.
We will disclose your Personal Information, Personally Identifiable Information and Registered User activity and any other details if we are requested to do so by law or by any regulatory or governmental authority or by any law enforcement agency, or upon receipt of a court order or a legitimate request by a third party (for example, the police) in investigating illegal activities to provide information concerning your activities on the Site.
We reserve the right to disclose information that we believe is appropriate or necessary to enforce the terms of the User Agreement, take precautions against liability, to investigate and defend ourselves against any third-party claims or allegations, to protect the security or integrity of the Site, and to protect our and any Registered Users rights, property, or personal safety.
We do not provide any Personally Identifiable Information to any other Registered Users.
8. Assignment of personal information on a sale, merger or liquidation of the Site
Any data that we have collected about you will be transferred, on a sale of the Site and/or on a sale of any interest in the Site, to any third party purchaser. In the event of such transfer taking place, we shall use reasonable endeavours to ensure that any purchaser continues to treat Registered Users Personal Information on a similar (and in any event on an as favourable) basis. We may not be able to control how your Personal Information is treated, used or managed in the unlikely event that we become insolvent, subject to administration or enter receivership.
9. Changes to the Policy
By submitting your information, you consent to the use of that information as set out in the Policy. The Policy may be revised periodically and any amended Policy will be effective fourteen (14) days after posting on the Site.
If we change the Policy, we will post the changes on this page and may place notices on other pages of the Site. We will indicate at the top of this page the date the Policy was last amended.
